Terms of Use for the Enzo App

All information about Enzo as the data controller under data protection law, our principles for processing your personal data, and details of your data subject rights can be found in our Privacy Policy.

5. Consent to Electronic Communication with TLS Encryption

For our electronic correspondence, we use TLS encryption (transport layer security). TLS encryption ensures that emails are encoded while being transmitted from the sender’s to the recipient’s server, making them unreadable during transmission. However, emails remain unencrypted on the sender's and recipient's devices and respective servers. TLS encryption is the standard procedure for securing email communications.
End-to-end encryption does not take place. With end-to-end encryption, emails are encrypted by the sender before being transmitted to the provider, who then forwards the encrypted message to the recipient’s server. This method requires a secure exchange of encryption keys and participation in the encryption process by both the sender and recipient, making it significantly more complex.
To enable fast and efficient communication with you, you agree that Enzo may transmit your personal data to you or third parties using TLS encryption. You explicitly waive end-to-end encryption when sending your data.
You may revoke this consent at any time by notifying Enzo. However, if you withdraw your consent, we may no longer be able to provide our services to you.

6. Changes to the Terms of Use

(1) We reserve the right to modify these Terms of Use in the future if there is a valid reason for doing so, provided that the changes are reasonable for you. A valid reason exists, for example, if ongoing developments in our products render these Terms of Use inaccurate or incomplete in describing the product and the associated rights and obligations for both you and us. A valid reason also exists if changes in the legal framework (e.g., new laws or court rulings) mean that these Terms of Use no longer adequately or effectively regulate the legal relationship between you and us.
Changes will be communicated to you via notification in the app, email, written notice, or other appropriate means. The notification will also specify the valid reason for the change. The changes are considered accepted and binding upon taking effect unless you object through one of the available communication channels. We will explicitly inform you of this consequence when announcing the changes. Your objection must be submitted within six weeks of the announcement of the changes.
(2) You can request a copy of these Terms of Use via email at any time.

7. Final Provisions and Jurisdiction

(1) If any provision of these Terms of Use is or becomes invalid due to legal rulings or new regulations, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally effective provision that most closely aligns with the intended purpose in an economically reasonable manner. The same applies to any regulatory gaps.
(2) The business relationship between you and us, as well as the use of the app, is governed by the laws of the Federal Republic of Germany, excluding international private law.
(3) For any present or future claims arising from the business relationship between you and us and the use of the app, the exclusive place of jurisdiction is Heidelberg, provided you are a merchant (Kaufmann) and the claim does not arise from an insurance contract or insurance brokerage. If, after concluding the contract, you relocate your residence or habitual residence outside the Federal Republic of Germany or if your residence or habitual residence is unknown at the time legal action is taken, Heidelberg shall also be the exclusive place of jurisdiction for all claims arising from this business relationship.

Terms of Use for the Enzo Online Mailbox

SafeHome GmbH provides insurance brokerage and consulting services for insurance products, which are marketed online under the name “Enzo” via web and app.
SafeHome GmbH offers you insurance-specific services completely paperless. An important part of these services is your online mailbox in the Enzo customer portal. All documents and records related to the Enzo insurance policy you have concluded will be made available to you in your online mailbox by SafeHome GmbH. SafeHome GmbH also manages the online mailbox as a trustee. We grant usage rights exclusively to natural persons with an Enzo insurance contract. You can access the online mailbox via the Enzo customer portal. Please also note the corresponding terms of use of our customer portal.
In your online mailbox, you have access to all documents and can also download them. Postal delivery is completely replaced. By using our services, you agree to the complete elimination of paper-based communication.
When we provide a new document or message in your online mailbox, we will notify you via email. You can then view the respective messages via https://heyenzo.com or a link in the email through a secure connection. Please also refer to our data protection information.

Of course, there is the option to receive individual documents by mail upon request. If this is of interest to you, you can request it via support@heyenzo.com.
We store the messages and documents in your online mailbox for a period of three years from the date they are made available in the online mailbox. During this period, you have the option to download them.
We ensure that no one except you and the technical administrators has access to your mailbox and its contents. It is also guaranteed that your documents cannot be subsequently modified or deleted.
If you cancel your insurance coverage and no longer have an active insurance contract managed by SafeHome GmbH, our obligation to provide you with information via the customer portal and/or the online mailbox ends as soon as your cancellation becomes effective. We will continue to store the documents in your mailbox for another three months. During this time, you can continue to download, save, or print them. After this period, your documents - and if no further contract exists with us - your online mailbox and access to the customer portal will be automatically and permanently deleted.

Terms of Use for the Enzo Customer Portal

SafeHome GmbH provides insurance brokerage and consulting services for insurance products, which are marketed online under the name "Enzo" via web and app.
SafeHome GmbH offers insurance customers a customer portal free of charge. With the customer portal, you can access the following services for free:
  • Targeted information gathering about insurance products offered by Enzo
  • Insurance application submission
  • Support for your insurance contracts
  • Reporting of insurance claims
  • Document and invoice review
  • Contract overview
By using our services, you agree that your customer portal access will be automatically set up upon contract conclusion. You also agree that the data required for inquiries and transactions will be provided to you on secure websites. The same applies to all insurance contracts you conclude via Enzo. If multiple contracts are concluded using the same email address, they will be consolidated in your customer account under the first email address provided.
To use our customer portal, you need an email address. To log in, you will receive a one-time link upon request. Access to the customer portal will be granted immediately once you agree to these terms of use and conclude an insurance contract through it.
Important information: All messages and documents will be provided to you exclusively in the Enzo customer portal in your personal Enzo online mailbox. Using our services without a customer portal and online mailbox is not possible.

Please note that the availability of the Enzo customer portal, as well as other Enzo internet offerings, may be temporarily limited or unavailable due to network disruptions, force majeure, necessary maintenance, or other events.

Within the functionalities of the customer portal, you can submit legally binding notifications and declarations of intent.
The agreement is concluded for an unlimited period from the moment of contract conclusion. If you cancel your Enzo contract and no active insurance contract managed by SafeHome GmbH exists, access will be automatically deleted.
Keep your email address login details confidential and do not share them with third parties. The username and password should not be stored digitally or written down in any form. If you suspect that third parties know your login details, please change your password immediately to prevent misuse of the Enzo customer portal. If you suspect or detect unauthorized use of your data, please report it to us immediately, and we will block access. Once there are no longer any reasons for blocking, we will unlock access again.
Without your consent, no one other than you and the responsible technical administrators of SafeHome GmbH can access the data in the customer portal.We handle your data carefully. For more information, please refer to: https://heyenzo.com/datenschutzvereinbarung
SafeHome GmbH may change these terms of use to a reasonable extent, considering your interests. We will notify you of changes in a timely manner, i.e., two months before they become effective. We assume your consent if you do not inform us of any rejection by the time they become effective.

Enzo Water Leakage Service

1. Who is your contracting party?

Your contracting party is SafeHome GmbH, Kurfürsten-Anlage 52, 69115 Heidelberg, Germany, Mannheim District Court, HRB 742339, hereinafter referred to as "we" or "us."

2. What services are provided?

SafeHome GmbH is the distributor of smart home water leakage sensor units (hereinafter "sensor units") that are installed on the exterior surface of drinking water supply pipes in buildings, collecting data about water flow. The data generated is evaluated online using software to detect damage to drinking water pipes at an early stage. The provision of these sensor units for drinking water supply pipes and the online software solution in accordance with legal obligations constitutes the full water leakage service provided by SafeHome GmbH. Other services and products not mentioned below are not part of this agreement and must be agreed upon separately.

3. Who is the service offering for?

3.1 Contracts are only concluded with owners of the properties to be serviced. Owners can appoint authorized representatives for this purpose. The authorization must be provided in writing. The properties to be serviced must not be purely commercial or industrial properties. Residential properties to be serviced must not have more than two residential units. In exceptional cases, residential buildings with more than two residential units can also be serviced. Please contact us before placing your order for this. Residential and commercial properties to be serviced must not have more than one commercial unit and one residential unit. The billing address must be within the Federal Republic of Germany.
3.2 In the case of a change of ownership, all rights and obligations under the contract are transferred to the buyer. The transfer of a contract from one property to another is not possible. We can still require payment of the service fee for the minimum contract term (see below).

4. How are the contracts concluded?

4.1 Our offers are always non-binding. Contracts are only concluded upon our written order confirmation and are based solely on the content of the order confirmation and these terms and conditions.

5. What pricing models are available?

5.1 The sensor units can be purchased for a one-time price or, based on a specific agreement, rented for an ongoing fee within an agreed minimum contract period. There is no right to rent.
5.2 To use the sensor units, a special online-based software solution is required, which SafeHome GmbH provides for an additional fee and within a contract term (subscriptions) with the voluntary option for extension. The exact terms of the contract periods are specified below in the terms and conditions.
5.3 If you have an insurance contract with an insurance plan certified by SafeHome GmbH, the additional fee according to section 5.2 is waived as long as the insurance contract remains in force and the sensor unit is used to monitor the main building located on the insured property identified in the insurance certificate. The insurance contract must be certified by SafeHome GmbH through a special declaration. Compatible insurance contracts that are not explicitly certified do not count as certified contracts.

6. What contract durations are there and how can you cancel?

6.1 The contract for the online-based software solution of the Enzo Sensor Water Leakage Service has a minimum term of 5 years, starting from the day the sensor units are delivered. During this minimum term, the service is covered by a one-time additional service fee of 70 EUR.
6.2 If an insurance contract according to section 5.3 exists only temporarily during the minimum contract term, we will invoice you for the portion of the service fee according to section 6.1 that applies to the remainder of the minimum term and collect this by direct debit. This amount is calculated by multiplying the number of days when no corresponding insurance contract exists by 1/1800 of the one-time service fee you would pay for 5 years. A concrete example would be: The sensor unit is delivered on the day the insurance begins. If you cancel your insurance contract on a date 1 year after the delivery of the sensor unit, we would charge you 1440 out of 1800 days, i.e., 56 EUR, and you can continue using the water leakage service for the next 4 years.
6.3 After the minimum contract term for the online-based software solution, you can extend the contract under the terms and conditions applicable at that time. If the contract is not extended, it will automatically terminate after the minimum term.
6.4 You will be informed before the end of the minimum term and have the option to extend the contract according to the terms in the then-current price list or to let it expire.
6.5 Termination during the minimum term is excluded unless otherwise agreed or permitted by law. In the case of termination or non-utilization of the service during the minimum term, there is no right to a refund of the purchase price or service fee, not even partially. You can instead let the contract expire. It will not automatically renew.
6.6 If there is an insurance contract according to section 5.3 beyond the minimum contract term, the additional fee according to section 6.3 will be waived as long as the insurance contract remains in force and the sensor unit is used to monitor the main building located on the insured property identified in the insurance certificate. The continuation of the contract term is considered agreed as long as the corresponding insurance contract remains in effect and the sensor unit is used to monitor the main building located on the insured property identified in the insurance certificate.
6.7 The contract durations regarding a potential rental of sensor units will be individually agreed upon. You do not have a right to rent.
6.8 A total or partial loss of the property to be serviced, as well as any impairment of its usability or reduction or alteration of the actual use of the property, do not justify any claims for reimbursement on your part.
6.9 You and we can terminate the contract without notice for an important reason. Important reasons include, for example:
  • You as the contracting party do not agree to the data protection consent declaration or you withdraw the consent. Third-party services that form the basis of this contract are permanently unavailable (e.g., mobile network).
  • The sensor data is not transmitted permanently.
A termination must be received by the other contracting party to be effective. Terminations must be in text form. If you receive a tariff discount on your insurance contract due to the proof we provide that your house is monitored by a water leakage sensor unit, it may be the case that your tariff discount will be canceled and charged to you. Your insurance contract is a legally independent agreement and will continue regardless.

7. What must you consider during delivery?

7.1 The prices for the Smart Water Sensor Unit and the water leakage service include statutory VAT and exclude shipping costs, unless otherwise specified.
7.2 If the delivery of the ordered goods is not possible, the purchase price already paid by you will be fully refunded. Further claims from you, especially claims for damages due to non-performance or delay, are excluded unless otherwise specified below.
7.3 The risk of accidental loss and deterioration of the goods passes to you as soon as the goods are handed over to you or a person authorized by you to receive them. If you have not selected a transport company on our behalf, the risk passes already when the goods are handed over to the transport company.
7.4 After the goods have been handed over to the transport company, we are no longer responsible for delays or problems related to the delivery. Any claims due to late delivery must be made directly to the transport company.
7.5 We are not liable for delivery delays that are outside of our control, including but not limited to strikes, natural disasters, wars, acts of terrorism, or other force majeure events.
7.6 The delivered goods remain our property until the full payment of all our claims arising from the business relationship. Any pledge or security transfer of the reserved goods is prohibited without the written consent of SafeHome GmbH.

8. What must you consider during payment?

8.1 Payment for the goods is made via SEPA direct debit. You are required to ensure that your account has sufficient funds. Other payment methods may be accepted upon prior agreement. You do not have a right to other payment methods.
8.2 You hereby irrevocably authorize us to collect the payments you owe at the time of the order via direct debit from the specified account.
8.3 If the direct debit cannot be processed due to an event for which you are responsible, you are liable for the costs incurred due to the failure. In this case, you are obligated to immediately settle the due amount, including incurred costs, via SEPA transfer upon our request, in order to maintain the order.
8.4 In the event of a delay in payment of more than 14 days after invoicing, we are entitled to charge reminder fees and default interest. The amount of the reminder fees is based on Section 288 of the German Civil Code (BGB). Additionally, we are entitled to demand immediate payment of the entire outstanding purchase price and service fee.
8.5 You are only entitled to set off claims if your counterclaims have been legally established, are undisputed, or have been acknowledged by us. You are only entitled to exercise a right of retention if your counterclaim is based on the same contractual relationship.

9. Right of Withdrawal and Withdrawal Instructions

9.1 Details about the right of withdrawal for consumers (private customers and homeowners' associations), including the conditions, procedure, and consequences of withdrawal, can be found in the withdrawal instructions of SafeHome GmbH. These are available at https://sensorhub.heyenzo.com/api/file/public/enzo/SENSOR_HUB/Enzo_Widerrufsbelehrung.pdf and will be provided to you as part of the contractual documents.
9.2 SafeHome GmbH is entitled to refuse the repayment in the event of withdrawal until it has received the goods back or you have provided proof that you have returned the goods, whichever occurs earlier.
9.3 SafeHome GmbH reserves the right to withhold an appropriate amount for any reduction in value caused by the use of the goods if the returned goods are not in proper condition.
9.4 If you are a business customer, you do not have a right of withdrawal. Any returns or cancellations must be separately agreed upon with SafeHome GmbH.

10. What warranties and guarantees do you receive?

10.1 Unless expressly agreed otherwise, the statutory warranty rights for consumers apply.
10.2 The limitation period for warranty claims is two years from the delivery of the goods.
10.3 Claims for defects do not apply in cases of only minor deviations from the agreed condition or only minor impairments of usability.
10.4 Obvious defects must be reported to us in writing within two weeks of receipt of the goods; otherwise, the warranty claim is excluded.
10.5 In the case of subsequent performance under the warranty, we are entitled to choose either to repair the goods or to deliver replacements.
10.6 No guarantees in the legal sense are provided by us.
10.7 If you are a business customer, the statutory warranty rights for consumers also apply. We may terminate the application of the statutory warranty rights for consumers with respect to business customers at any time, without affecting the remainder of the terms and conditions. The statutory warranty rights of business customers remain unaffected.

11. Limitation of Liability

11.1 We are not liable for typographical errors in order forms, even if they were prepared by us for you. You are responsible for ensuring that all information is correct before submitting the order form or commissioning. For any changes to sensor units, sensor unit sets, or addresses, SafeHome GmbH will charge the customer a flat processing fee of €100. Corrections to invoices will not be made for tax reasons.
11.2 You are obligated to inform us immediately about any damage to the device.
11.3 In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited to foreseeable damages at the time of contract conclusion.
11.4 The service is intended as an aid and does not provide insurance against water leaks or resulting damages. You should take additional precautions and must not rely solely on the product to prevent or minimize water leaks. We also do not provide any warranty or guarantee for water savings or the accuracy of leakage reports through the service.
11.5 You acknowledge that we are not responsible for actions, omissions, errors, failures, delays, or other performance disruptions caused by circumstances, events, or other causes outside our control.
11.6 We are not liable for the non-delivery of notifications or other communications to you if the non-delivery is due to circumstances outside of our control. This includes, but is not limited to, technical problems, network failures, email service malfunctions, or other disturbances in electronic communication. The same applies if you are not reachable by phone or otherwise.
11.7 We also do not accept liability for your unavailability due to incorrect, outdated, or incomplete contact information that you have provided to us.
11.8 We are further exempt from any liability if the fulfillment of our contractual obligations becomes impossible or unreasonably difficult due to force majeure events, including but not limited to natural disasters, war, terrorism, riots, epidemics, pandemics, strikes, or legal changes after the conclusion of the contract. In such cases, we are entitled to suspend the fulfillment of our obligations for the duration of the disruption and for a reasonable startup period after the disruption ends, or to withdraw from the contracts entirely or partially.
11.9 We exclude any further liability, particularly concerning the following circumstances and events:
11.9.1 Damages caused by water leaks, regardless of whether these leaks were detected by the product or not.
11.9.2 Hardware defects caused by water damage, false alarms, damage to the sensor unit, or other items, particularly pipes due to improper installation on the pipe.
11.9.3 Water loss.
11.9.4 Lost revenue, lost profits, and other financial damages, as well as other indirect damages such as lost tariff discounts.
11.9.5 Any additional costs or compensation arising from damages, damage prevention, or damage reduction actions that you undertake in connection with a suspected or actual water leak.
11.9.6 To the extent our liability is excluded or limited, this also applies to the personal liability of our employees, workers, representatives, and subcontractors.

12. Data Protection and Consent

12.1 The installed sensor units collect water flow data. You give us your consent to collect, store, and automatically process the generated data, as well as data about the building (address, number of floors, location of the sensor units in the building). The data will be the property of SafeHome GmbH. You also assure us that you have informed all parties involved in the serviced properties and that new parties will be informed upon moving in.
12.2 Furthermore, you give your consent for the storage and automatic processing of your personal data (name, possibly company name, account number/IBAN, contact person, phone number, email address).
12.3 Even in the case of inactive subscriptions and inactive insurance contracts, the sensor data is not automatically decoupled from the personal data you provided, and the sensor units will continue to send data to us. The agreement for data processing continues silently until you explicitly cancel or request the deletion of the data according to 12.2. Once the sensor units are decoupled due to data deletion, they cannot be reused.
12.4 The purpose of the sensor units is to generate and send data to us. This means that the units will always send data, regardless of whether you have an active contract with us or not, and regardless of whether you have requested data deletion according to 12.2. If you want the sensor to stop sending data, you must remove it from the pipe.
12.5 You will receive information about potential water leaks from SafeHome GmbH via the app and email.
12.6 You do not have access to the raw data of the sensor units.
12.7 You can withdraw your consent regarding your data according to 12.2 at any time from Enzo. If this consent is withdrawn, we may no longer be able to provide our services to you. This does not entitle you to any refund claims.
12.8 You agree that we may transmit personal data, measurement values, and evaluations within the scope of contractual data transfer, e.g., in the event of damage, for proof purposes, for product optimization, or quality assurance, to insurers and damage service providers. This also includes reporting absence or errors in data, as well as the non-installation of the sensor unit.
12.9 You agree that both we and the insurers and damage service providers we work with are entitled to collect, use, process, and exchange your contract-related personal data.
12.10 For the fulfillment of the contract, we will provide your data to the shipping company assigned to deliver the goods, insofar as this is necessary for the delivery of ordered goods (including your email address). To process payments, we will also forward the payment data collected to the bank responsible for the payment and any payment service providers we have commissioned.

13. Your Obligations

13.1 The use of the water leakage service is particularly dependent on the following requirements.
13.1.1 Your smartphone must have a compatible operating system (Android or iOS in the appropriate version).
13.1.2 Your smartphone must be functional, ready for use, and support the functions described here.
13.1.3 The app must be installed on your smartphone. The connection of the water leakage sensor unit to the app via the internet must be successfully completed.
13.1.4 Current software updates must be installed. The water leakage sensor unit must be installed and activated according to the instructions on the main drinking water supply line of the residential building.
13.1.5 The water leakage sensor unit must be connected to the smartphone via the internet.
13.1.6 If the app shows a warning or error message, you will not receive any emails with error notifications.
13.1.7 The smartphone must be connected to a mobile network. Voice telephony and data transmission must be possible. The location function and data transfer of the smartphone must be activated, operational, and enabled for the app.
13.1.8 The sensor units are battery-operated and can be charged with a USB-C cable (not included). The battery can also be replaced. Batteries are consumables and must be regularly purchased and replaced at your expense. You are responsible for charging the sensor and replacing the battery to be able to use the services under these terms and conditions. Your statutory warranty rights remain unaffected.
13.1.9 If you purchase sensor units as property, you are responsible, beyond the statutory warranty obligations, for the maintenance and replacement of sensor units during the term of the online-based software solution at your own cost. Replacement deliveries, spare parts deliveries, replacement battery deliveries, configuration services, and assembly will be charged according to the terms of the price list valid at the time of the order.
13.1.10 If the sensor units are provided to you under a rental agreement, SafeHome GmbH will provide replacement units within 4 weeks during the rental period. This excludes defects, misuse, and damage to the sensor units that are attributable to the customer. You have no right to rent the units.

14. Legal Notices Regarding Waste Regulations

14.1 Information According to the Battery Act
In connection with the sale of our batteries or accumulators, we, as a retailer, are obligated by the Battery Act to inform our customers of the following: Please dispose of old batteries as required by law – disposal in household waste is expressly prohibited by the Battery Act – at a municipal collection point or return them to the local retailer free of charge. Batteries received from us can be returned free of charge after use at the address below or sent back to us by mail with sufficient postage: SafeHome GmbH, Kurfürsten-Anlage 52, 69115 Heidelberg. Batteries that contain harmful substances are marked with the symbol of a crossed-out trash can, similar to the symbol in the image on the left. Below the trash can symbol is the chemical name of the harmful substance – in the example on the left, "Cd" for cadmium. "Pb" stands for lead, "Hg" for mercury.
14.2 Law on the Marketing, Take-back, and Environmentally Compatible Disposal of Electrical and Electronic Devices
Since August 13, 2005, manufacturers are required to take back old electrical devices free of charge. Manufacturers must label their electrical and electronic devices that were put into circulation after November 23, 2005, with a symbol (a crossed-out trash can on wheels). As a retailer, we are legally obligated to inform you that such old devices should not be disposed of as unsorted municipal waste but must be separately collected and disposed of through local collection and return systems. According to the "ElektroG" law of March 23, 2005, we are registered with the competent authority and have demonstrated a solvent-proof guarantee for the financing of the take-back and disposal of their electrical devices.
14.3 Information for Consumers on Take-back According to the Packaging Ordinance
According to the provisions of the Packaging Ordinance, we are required to take back the packaging of our products that do not carry the mark of a nationwide disposal system (such as the "Green Dot" of Duales System Deutschland AG or the "RESY" symbol) and ensure their reuse or disposal. We will then provide you with a municipal collection point or a disposal company in your area that will accept the packaging free of charge. If this is not possible, you have the option to send the packaging back to us: SafeHome GmbH, Kurfürsten-Anlage 52, 69115 Heidelberg. The packaging will be reused by us or disposed of in accordance with the provisions of the Packaging Ordinance.
14.4 Indemnification
You agree to indemnify us from any damages and claims arising from your failure to dispose of waste in accordance with the law.

15. Industrial Property Rights

15.1 We expressly reserve all industrial property rights and copyright concerning the delivered goods, all products, designs, molds, patterns, services, illustrations, and other documents.
15.2 You are not authorized to resell, sublease, or otherwise transfer any rights to the reserved goods.
15.3 The use of the special online-based software solution is not compatible with third-party sensor units or other hardware. The water leakage sensor units are not compatible with third-party software, hardware, and battery solutions.

16. How Can We Change Our Terms and Conditions and Services?

16.1 The Terms and Conditions (T&Cs) may be amended if necessary to adapt to developments that
  • were unforeseeable at the time of contract conclusion,
  • were not initiated or influenced by SafeHome GmbH,
  • whose non-consideration would significantly disturb the balance of the contract, and
  • as long as essential provisions of the contract are not changed. Essential provisions include those regarding the type and scope of the contractually agreed services and the duration, including cancellation provisions.
16.2 The T&Cs may also be adjusted if regulation gaps arise after the conclusion of the contract that cause significant difficulties in the implementation of the contract. This may especially be the case if case law changes regarding the effectiveness of provisions of these T&Cs, if one or more provisions are declared invalid by the courts, or if a change in law leads to the invalidity of one or more provisions of these T&Cs.
16.3 The contractually agreed services can be changed if and to the extent that this is necessary for a valid reason, unforeseeable at the time of contract conclusion, and the relationship between the services of SafeHome GmbH and your consideration is not shifted to your disadvantage, making the change reasonable for you. A valid reason exists:
  • if the service in the previously agreed form can no longer be provided due to new technological developments, or
  • if new or changed legal or other governmental requirements necessitate a change in services.
16.4 Any changes to the T&Cs or services according to sections 16.1 to 16.3 will be communicated to you in writing at least one month, and no later than two months, before their planned effective date. You have the right to terminate the contract without notice and at no cost, effective at the time the changes come into effect, if you do so in writing. You may declare your termination within three months of receiving the notice of changes. In the notice of changes, we will particularly highlight the content and timing of the contract change and your existing right to cancel.
You are not entitled to terminate if the changes
  • are exclusively to your benefit,
  • are purely administrative in nature and have no negative impact on you, or
  • are required by Union law or national law.

17. Final Provisions

17.1 If one or more provisions of these Terms and Conditions (T&Cs) are or become invalid, the validity of the remaining provisions will not be affected.
17.2 The law of the Federal Republic of Germany applies. This choice of law applies to you without any limitations.
17.3 The place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seller's place of business, unless the customer is a merchant, a legal entity under public law, or a special fund under public law.
17.4 We would like to point out that when using insurance-specific website services and insurance services provided by SafeHome GmbH, the respective insurance conditions, additional separate documents (e.g., cancellation instructions, initial information) in accordance with consumer information obligations, and additional separate terms of use apply.
